Well Fed the old design is actually illegal now , as the BCA code states that it cannot have points that can be climb by a child also they have made changes in the height and spaces .If it is already there they cannot make you remove it, but if it is to be replaced it must conform.
here is some of the code. The current BCA requirements are that a balcony balustrade have the following attributes: ? The top of the railing must be least 1 metre (1000mm) from the ground. Any opening must not allow a 125mm sphere (ie childs head) to pass through. So the vertical components must not be more than 125mm apart. The gap between the balcony surface to the bottom rail must be no more than 100mm. For balconies with a fall height of more than 4m there must not be any horizontal or near horizontal elements between 150mm and 760mm above the floor that facilitate climbing. -------------------- |

It is the same BCA code which is used in staircases , balcony and verndahs Fed , they are not real tough on it at present only on new building or renovations that require permissions, but be assured that how some of these BCA codes are going they will be acted on.
Another way they can make money is all I see in it, but councils are getting tough on some of the new BCA codes, -------------------- |

Poly, your balustrade looks great.. Don't put it through council though, they will get you to put a few more verticals in there mate.
Oz missed an important part of the code though.. It only constitutes as a balcony when there is +600mm of free fall. (Drop). By the looks of it, your at about 800mm. Sorry to bore you all... lol -------------------- Don't hate me, cause you ain't me... :)

Poly as I said its BCA Building code of Australia so vic is going to be the same , but M8 there is nothing to worry about as it really only gets enforced on new properties and major renovations that require council .
